Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Bloom, the early-learning activity app operated by WonderKiln (“Bloom,” “we,” “us,” or “our”). By creating an account or using Bloom, you agree to these Terms. If you do not agree, please do not use Bloom.

1. Description of Service

Bloom suggests AI-personalized, age-appropriate early-learning activities for children ages 0–5, informed by information you provide about your child and general developmental guidance (including Ohio’s Early Learning & Development Standards and the CDC’s “Learn the Signs. Act Early.” milestones). Bloom is an educational and enrichment tool for families and is not a substitute for professional medical, developmental, or educational evaluation, advice, diagnosis, or treatment. Always use your own judgment about what is safe and appropriate for your child, and supervise your child during any suggested activity.

2. Eligibility & Accounts

You must be at least 18 years old and the parent or legal guardian of any child whose information you add to Bloom. You agree to provide accurate information, keep your login credentials secure, and notify us promptly at [email protected] of any unauthorized use of your account.

3. School District Partnerships

Some families access Bloom through a partnership with their school district using an invite code. If you join Bloom this way, your district administrator may have access to limited aggregated or administrative information as described in our Privacy Policy. Additional terms from your district’s agreement with us may also apply to district-provided access.

4. Acceptable Use

You agree not to:

• Use Bloom for any unlawful purpose or in a way that could harm a child;
• Attempt to reverse engineer, scrape, or interfere with Bloom or its infrastructure;
• Misrepresent your identity or your relationship to a child;
• Share an invite code you are not authorized to use; or
• Upload or submit content that is unlawful, harmful, or infringes on others’ rights.

5. Content & Intellectual Property

Bloom, its logo, and the activities, text, and materials we generate or provide (“Bloom Content”) are owned by WonderKiln or our licensors. We grant you a limited, non-exclusive, non-transferable license to use Bloom Content for your personal, non-commercial, family use. You may not republish, sell, or redistribute Bloom Content without our permission.

6. AI-Generated Content Disclaimer

Activities in Bloom are generated with the help of artificial intelligence and are offered as suggestions only. We take reasonable steps to keep suggestions age-appropriate and safe, but we cannot guarantee that every suggestion will be perfectly suited to your child. You are responsible for reviewing each activity and supervising your child to ensure it is appropriate and safe given your child’s individual needs and environment.

7. Fees

Bloom is currently provided free of charge to families, including those who join through a participating school district. If we introduce paid plans or features in the future, we will clearly disclose pricing and obtain your consent before charging you.

8. Beta Program & Data Deletion

Bloom is currently offered as a beta program. During the beta, features may change, be added or removed, and the service may be interrupted. At the end of the beta period, all data associated with your account—including your profile, child information, activity history, and progress—will be permanently deleted unless we notify you otherwise and obtain your consent to continue. We will provide reasonable notice before the beta ends.

9. Termination

You may stop using Bloom and delete your account at any time from within the app or by contacting us. We may suspend or terminate your access if we reasonably believe you have violated these Terms or misused Bloom.

10. Disclaimers

Bloom is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that Bloom will be uninterrupted, error-free, or that any activity suggestion is fit for your child’s specific circumstances.

11. Limitation of Liability

To the fullest extent permitted by law, WonderKiln will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Bloom. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws principles.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email before they take effect. Continued use of Bloom after changes take effect means you accept the updated Terms.
